I desperately need information, advice, suggestions and anything else that you have. My sister is currently in what I am told is a psychiatric "holding" facility at a local hospital in Massachusetts. I'm not in the same state, so I have to rely on what people tell me. My sister had a nervous breakdown and was taken to this hospital a few days before Christmas. Her husband does not want to sign her out because he currently controls all of the assets and they were divorcing. As you might guess, this is much messier than it sounds in a few short sentences, but what I want is simple, if not easy. I want my sister OUT or AT LEAST in a facility that might actually help her. As they are in Massachusetts, I have had very little success in finding out any usable information. Court records, DMV, property, marriage, all of those things are very difficult to obtain, especially from out of state. Any ideas? Where to start? What I can do? Who to call? Agencies? People? Places? Information? Organizations? Anything? I will be grateful for any help that you can provide.

You will need to talk to an attorney first, to find out what your options to help her are. It will all come down to what is permissible by Massachusetts law. An attorney in your state can guide you in the process. Then come back here for any records research help you may need, ask more questions and use the search tool to find others whom may have posted on similar topics.

This suggestion is not meant to replace the investgative work you are doing, It is meant as a safety element for your sisters care and that her rights are being met while you figure things out.

By law, every patient must have and documented, Team conferences where care and discharge are decided. The nurses ,the doctor social workers , others involved in care meet. These people work for the hospital. when there is question and things seem to long in happening ,Get a patient advocate, They do not work for the hospital. the hospital may supply them office space ,some work for goverment agencies and and some are trained and experienced but do on voluntary basices

Their presence can not be refused, and in most cases, things and attitudes change when u say u want a advocate involved. first you may be told that they prefer to use there own social workers (who are hospital employees) A advocate brings an investgative process the staff doesn't wish to be bothered with. It is an excellent resoure. And can change the whole picture of things. Good Luck
